Officer Recommendation Date: 21 October 2026
Decision Date: 21 October 2026
Decision Type: REFUSED
Temporary Expiry Date:
Decision Level/Committee: Delegated (Part 2A)
Conditions / Reason for Refusal: 01 The proposed change of use to an Adult Gaming Centre (sui generis) would result in the occupation of a unit within the Primary Shopping Frontage by a use which does not support or contribute towards the retail function of the frontage. The proposal would diminish the concentration of retail and retail-compatible town centre uses at a key location within Rotherham Town Centre, undermining the objective of maintaining and enhancing the vitality, viability and attractiveness of the Primary Shopping Frontage. As such, the proposal is contrary to Policies SP19 (Development Within Town, District and Local Centres) and SP20 (Primary Shopping Frontages) of the Rotherham Local Plan Sites and Policies Document and the objectives of the National Planning Policy Framework which seek to support the vitality and viability of town centres. 02 The proposed Adult Gaming Centre would operate on a 24-hour basis from premises located on College Street, outside the areas identified by Policy SP25 (Rotherham Town Centre Evening Economy) as the preferred focus for late-night activity. The proposal would not contribute positively towards the Council's strategy for directing and managing evening economy uses within Rotherham Town Centre and would fail to support the creation of a diverse and attractive town centre offer for a broad range of users. The proposal is therefore contrary to Policy SP25 of the Rotherham Local Plan Sites and Policies Document. 03 The proposed 24-hour operation would result in customer arrivals, departures and associated activity throughout the day and night in close proximity to existing residential accommodation. By reason of the resulting noise and disturbance, the development would cause unacceptable harm to the living conditions of nearby occupiers. The proposal is therefore contrary to Policies SP25, SP52, and CS27 of the Rotherham Local Plan and DP3, DP4 and HC1 of the National Planning Policy Framework POSITIVE AND PROACTIVE STATEMENT The applicant did not enter into any pre application discussions with the Local Planning Authority. No discussions have taken place during the determination of the application as no alterations have been identified that would enable a scheme of this nature to be supported. It was not considered to be in accordance with the principles of the National Planning Policy Framework and resulted in this refusal.
