The Council considers that the relinquishing of adopted highway land to facilitate additional parking in this area has not been justified. The land forms part of the public highway network and must remain available for the safe and efficient movement of all highway users. The development would also reduce flexibility for future highway improvements, maintenance activities, utility installations, sustainable transport initiatives, or traffic management schemes. Accordingly, the proposed development conflicts with Policy SP56 ‘Car Parking Layout’ and the wider aims of the National Planning Policy Framework.

The Council also considers that the loss of the highway tree has not been justified, nor any alternative planting considered and this conflicts with the aims of policy SP33 ‘Conserving and Enhancing the Natural Environment’ which seeks to conserve green infrastructure.
POSITIVE AND PROACTIVE STATEMENT
The applicant did not enter into any pre application discussions with the Local Planning Authority. It is not possible to support a scheme of this nature and no amendments have been identified at this time to make it acceptable. It was not considered to be in accordance with the principles of the National Planning Policy Framework and resulted in this refusal.
