Conditions / Reason for Refusal: 01 The Council considers that the extended opening hours, increased outdoor seating at a raised level to the rear, the formation of a drinking area to the front of the premises and relaxation of consumption of alcohol in proposed outdoor areas, would result in a demonstrable impact on the amenity of neighbouring residents. Neighbouring residents will be subjected to hearing raised voices, amplified music and amplified voices from the outdoor areas when using their gardens and bedrooms and from general comings and goings, customers loitering and car doors opening and closing at unsocial hours. Accordingly, the proposed amendments would result in unacceptable levels of noise nuisance and general disturbance to local residents, late and night and in the early hours of the morning and as such the changes are considered to be contrary to adopted Local Plan policies CS27 ‘Community Health and Safety’ and SP52 ‘Pollution Control’, as well as paragraph 135(f) of the National Planning Policy Framework. 02 The proposed ‘airlock’ conservatory style addition at first floor level on the rear elevation would result in an incongruous addition to the building that would have an adverse impact on the character and appearance of the building. The addition would be in conflict with adopted Local Plan policies CS28 ‘Sustainable Design’ and SP55 ‘Design Principles’. Informative(s) 01 It is noted that there is a large projecting illuminated sign on the frontage of the building. The sign does not benefit from Advertisement Consent and is therefore illegal. It is unlikely that the sign could be supported due to its size and luminance. Therefore, it is advised that the sign is removed from the premises within 1 month from the date of this decision. If the sign has not been removed an assessment will be made as whether to take any further action by way of prosecution. POSITIVE AND PROACTIVE STATEMENT The applicant did not enter into any pre application discussions with the Local Planning Authority. It is not possible to support a scheme of this nature and no amendments have been identified at this time to make it acceptable. It was not considered to be in accordance with the principles of the National Planning Policy Framework and resulted in this refusal.
