Conditions / Reason for Refusal: 01 The development hereby permitted shall be commenced before the expiration of three years from the date of this permission. Reason In order to comply with the requirements of the Town and Country Planning Act 1990. 02 The permission hereby granted shall relate to the area shown outlined in red on the location plan and the development shall only take place in accordance with the submitted details and specifications as shown on the approved plans (As set out below):- Drawing numbers • Location Plan (titled 39 Herringthorpe Avenue, S65 3AA, no drawing number) • Block Plan (no drawing number) • Proposed Ground Floor 526/5 • Proposed First Floor 526/6 • Proposed Roof Plan 526/9A, amended plan received on 24.03.2026 • Proposed Loft 526/7C, amended plan received on 27.03.2026 • Proposed Elevations 526/8B, amended plan received on 27.03.2026 Reason To define the permission and for the avoidance of doubt. 03 The materials to be used in the construction of the external surfaces of the development hereby permitted shall be in accordance with the details provided in the submitted application form. The development shall thereafter be carried out in accordance with these details. Reason In order to ensure a satisfactory appearance in the interests of visual amenity. 04 Tiles hanging of a similar appearance to the roof tiles used in the construction of the existing roof shall be used for the external surfaces of the dormer window extension hereby approved. Reason In order to ensure a satisfactory appearance in the interests of visual amenity. 05 All additional windows above ground floor level on the south-western side elevation, including the approved dormer window, shall be obscurely glazed and fitted with glass to a minimum industry standard of Level 3 obscured glazing and be non-openable, unless the part(s) of the windows which can be opened are more than 1.7 metres above the floor of the rooms in which the windows are installed. The windows shall be permanently retained in that condition thereafter. Reason In the interests of amenities of the occupiers of adjoining properties. Informative 01 The applicant is reminded that development must accord to the approved plans. Any further increases in roof and eaves height are unlikely to be considered acceptable and enforcement action will be considered should the height of the dwelling be higher than approved in this application. Positive and Proactive Statement During the determination of the application, the Local Planning Authority worked with the applicant to consider what amendments were necessary to make the scheme acceptable. The applicant agreed to amend the scheme so that it was in accordance with the principles of the National Planning Policy Framework.
