Conditions / Reason for Refusal: 01 It is considered that the proposed development fails to achieve an acceptable standard of design in terms of the visual appearance of the building and the internal size of the proposed flats, contrary to Local Plan Policies CS28 ‘Sustainable Design’, SP55 ‘Design Principles’ and the nationally described space standards. 02 The proposed development by virtue of the limited separation distance to 102 Clough Road, would result in significant overlooking to the rear garden and habitable room windows of No.102 Clough Road, the amenity of existing future occupiers of both No.102 and the proposed development. As such, the proposed development would be contrary to paragraph 135(f) of the National Planning Policy Framework (2024) and Local Plan policy SP55 ‘Design Principles’. 03 The Council considers that the proposed parking spaces are inadequate in size to cater for standard motor vehicles, resulting in parked vehicles overhanging the adopted footpath, to the detriment of pedestrians and highway safety. POSITIVE AND PROACTIVE STATEMENT The applicant did not enter into any pre application discussions with the Local Planning Authority. Consideration of the scheme during the determination of the application have identified that it is not possible to support a scheme of this nature nor would any amendments make it acceptable. It was not considered to be in accordance with the principles of the National Planning Policy Framework and resulted in this refusal.
