That a Lawful Development Certificate be REFUSED in respect of the proposed dormer at 75 St. Johns Road, Swinton, Mexborough, Rotherham, S64 8QJ for the following reason:
Based on the evidence submitted, it is considered that the proposed dormer at 75 St. Johns Road, Swinton, Mexborough, Rotherham, S64 8QJ shown on the submitted drawing (Proposed Plan – drawing number 4), if constructed in accordance with the submitted plans would not be lawful. The proposed dormer would exceed the height of the highest part of the existing roof and would extend beyond the plane of an existing roof slope which forms the principal elevation of the dwellinghouse and fronts a highway. The part of the proposed side window that would open also appears to be under 1.7m from the floor level of the proposed room, and no information has been submitted regarding the external materials of the dormer and whether the proposed side window would be obscure glazed. Therefore, the proposed dormer is not in compliance with the criteria outlined within Schedule 2, Part 1, Class B of the Town and Country Planning (General Permitted Development) (England) Order 2015, as amended.
