The proposal involves excavation within the Root Protection Areas of trees protected by a Tree Preservation Order, with a high likelihood of root disturbance and severance. Insufficient arboricultural information has been submitted to demonstrate that the development can be carried out without causing unacceptable harm to the protected trees. As such the development is contrary to Local Plan policies CS19 (Green Infrastructure), CS20 (Biodiversity and Geodiversity), and fails to accord with the guidance set out in BS5837:2012 – Trees in relation to design, demolition and construction, Wickersley Neighbourhood Plan, NPPG and the NPPF.
Positive and Proactive Statement
The applicant did not enter into any pre application discussions with the Local Planning Authority. Whilst discussions during the determination of the application have identified a possible acceptable alternative to this proposal, the applicant has been unwilling to amend the scheme. This was not considered to be in accordance with the principles of the National Planning Policy Framework and resulted in this refusal.
