Conditions / Reason for Refusal: Reasons for Refusal 01 Notwithstanding the considerations that the easternmost building is unlawful and therefore cannot be converted, the existing buildings are not capable of conversion without substantial alterations and construction work. As such, the development is considered to be inappropriate in the Green Belt and has a detrimental impact on the openness of the Green Belt. No very special circumstances have been provided to outweigh the harm to the Green Belt in this instance. As such, the proposals are contrary to Policies CS4 ‘Green Belt’ and SP2 ‘Green Belt’ and guidance contained in the Council’s Supplementary Planning Guidance ‘Green Belt Guidance 5 and the NPPF. 02 Toad Lane is unsuitable to cater for the additional number and size of vehicles generated by the proposal in view of its restricted width, adverse alignment and lack of separate pedestrian provision. The development, therefore, results in vehicular and vehicular/ pedestrian conflict to the detriment of road safety. 03 The scale mass and design of the proposed converted barns would harm the setting of the adjacent Grade II listed building, known as the Granary and dovecote with attached barn, and would harm the setting of the adjacent Brampton-en-le-Morthen Conservation Area. As such, the proposed development is contrary to Local Plan Policies CS23 ‘Valuing the Historic Environment’, SP40 ‘Listed Buildings’ and SP41 ‘Conservation Areas’. 04 The proposed layout would not provide sufficient private amenity space for future occupants, creating a poor residential layout contrary to the advice contained in the South Yorkshire Residential Design Guide. 05 The applicant has failed to provide sufficient information that demonstrates no net loss of biodiversity at the site before and after development has taken place. As such, the proposal is contrary to the requirements of Local Plan Policy SP33 ‘Conserving and Enhancing the Natural Environment’ and to the statutory requirement to demonstrate BNG plus 10%. 06 The proposal represents an unsustainable form of development being reliant on private car use, contrary to Local Plan Policy SP64 ‘Access to Community Facilities’ and the objectives set out within the NPPF. POSITIVE AND PROACTIVE STATEMENT The applicant did not enter into any pre application discussions with the Local Planning Authority. It is not possible to support a scheme of this nature nor would any amendments make it acceptable. It was not considered to be in accordance with the principles of the National Planning Policy Framework and resulted in this refusal.
