The council considers that the shop being provided at the premises has an unacceptable impact on residential amenity due to the comings and goings of customers to the shop in a residential area contrary to paragraph 131 of the National Planning Policy Framework and Policy SP11 Development in a Residential Area.

Enforcement action has been authorised to secure the cessation of the use of the premises for cake shop, with a compliance period of 1 month and you should take the appropriate steps to avoid formal enforcement action by the Council. In addition, any unauthorised signage should be removed.

If the applicant wishes to keep the outbuilding on site a subsequent householder planning application will be required.
POSITIVE AND PROACTIVE STATEMENT
The applicant did not enter into any pre application discussions with the Local Planning Authority. Discussions during the determination of the application have identified that it is not possible to support a scheme of this nature nor would any amendments make it acceptable. It was not considered to be in accordance with the principles of the National Planning Policy Framework and resulted in this refusal.
(B) That the Chairman and Vice Chairman in conjunction with the Director of Planning Service, authorise the service of an Enforcement Notice under Section 172 of the Town and Country Planning Act 1990, on the OWNER / OCCUPIER of, and anyone else having an interest in, the land at 15 Hardwick Street, Dalton, requiring the use of the premises for cake shop within 1 month. Prosecution action is also authorised should the appropriate steps not be carried out within the specified time periods
