The proposed pergola by virtue of its siting, appearance and materials to the front of the property, would introduce an incongruous feature which would be clearly visible within the street scene and would be detrimental to the appearance of the host property and street scene in general. As such the development is contrary to Local Plan policies CS28 ‘Sustainable Development’ and SP59 ‘Shop Front Design’, as well as the Council’s SPD ‘Shop Front Design’ and the NPPF.
Positive and Proactive Statement
The applicant did not enter into any pre application discussions with the Local Planning Authority. It is not possible to support a scheme of this nature and no amendments have been identified at this time to make it acceptable. It was not considered to be in accordance with the principles of the National Planning Policy Framework and resulted in this refusal.

Enforcement action has been authorised requiring the removal of the pergola with a compliance period of 3 months from the date that any enforcement notice comes into effect. Appropriate action should be taken to secure the removal of the pergola to avoid formal enforcement action.
