The Council considers that the proposed building, by virtue of its height and position, would form a prominent feature in the streetscene which would have a detrimental impact on visual amenity and the living conditions of the occupiers of the properties to the rear by way of overbearing impact and loss of light. Accordingly, the proposal is contrary to the aims of Local Plan Policies CS28 ‘Sustainable Design’ and SP55 ‘Design Principles’ as well as the Supplementary Planning Document – ‘Householder Design Guide’, and would also be in direct conflict with the requirements outlined within the National Planning Policy Framework and the National Planning Policy Guidance.

Enforcement action has also been authorised requiring the reduction in the height of the partially erected outbuilding to a maximum 2.5m, with a compliance period of 3 months from when any enforcement notice comes into effect.
Appropriate action should be taken as soon as possible to avoid the Council serving a formal Enforcement Notice in this respect.
POSITIVE AND PROACTIVE STATEMENT
The applicant did not enter into any pre application discussions with the Local Planning Authority. It is considered that it is not possible to support the partially completed scheme and that the applicant should revert to the previously approved scheme for which the Lawful Development Certificate was issued. It was not considered to be in accordance with the principles of the National Planning Policy Framework and resulted in this refusal.
