Conditions / Reason for Refusal: The proposed development does not comply with the conditions, limitations or restrictions applicable to development permitted by Class AA of the Town and Country Planning (General Permitted Development) (England) Order 2015 as amended which exceeds the limits in paragraph AA.1(i) and AA.2(a). AA.1 (i) any additional storey is constructed other than on the principal part of the dwellinghouse; Prior approval is refused as a first floor front gable structure would be erected according to the proposal, over part of the dwelling which is not considered the “principal part” of the dwellinghouse as defined in AA.4. AA.2 (2)(a) the materials used in any exterior work must be of a similar appearance to those used in the construction of the exterior of the existing dwellinghouse; Prior approval is refused as the proposed windows, doors and garage doors proposed are not of a colour matching the doors and fenestration of the existing dwellinghouse. Informative It is noted that the height of the existing flat roof extension at the application dwelling is also proposed to be increased according to the submitted proposed plans. The applicant is reminded that Class AA does not allow for such changes. Due to the total width of the existing flat roof extension exceeding half the width of the original dwellinghouse and parts of it is located to the side elevation of the original dwelling, permitted development rights under A.1(j)(iii) of Class A would also not be met. Planning permission is therefore required for the increase in height of the existing flat roof extension.
