Conditions / Reason for Refusal: 01 The permission hereby granted shall relate to the area shown outlined in red on the approved site plan and the development shall only take place in accordance with the submitted details and specifications as shown on the approved plans (as set out below) Location Plan MJ 04 Mar 2016 Site Plan MJ 03 Mar 2016 Plan and existing and proposed MJ 02 Feb 2015 Reason To define the permission and for the avoidance of doubt. 02 The full upstand kerb shall be retained as indicated on the approved site plan. Reason In the interests of road safety. 03 The approved railings to be located to the front of the building, shown on the approved site plan shall be retained for the duration of the development. Reason In the interests of road safety. 04 The part of the site to be used by vehicles shall be constructed with either; a/ a permeable surface and associated water retention/collection drainage, or; b/ an impermeable surface with water collected and taken to a separately constructed water retention/discharge system within the site. The area shall thereafter be maintained in a working condition. Reason To ensure that surface water can adequately be drained and to encourage drivers to make use of the parking spaces and to ensure that the use of the land for this purpose will not give rise to the deposit of mud and other extraneous material on the public highway in the interests of the adequate drainage of the site and road safety. 05 The car parking area shown on the approved site plan shall be maintained for car parking for the duration of the development. Reason To ensure the provision of satisfactory garage/parking space and avoid the necessity for the parking of vehicles on the highway in the interests of road safety. 06 The retail unit (Use Class E) shall only be open to customers between 07:30hrs and 22:00hrs from Monday to Saturday, and between 08:00hrs and 20:00hrs on Sundays. The hot food takeaway (Use Class Sui Generis) shall only be open to customers between 11:00hrs and 23:00hrs. Deliveries shall only take place at the premises between 08:00hrs and 18:00hrs Monday to Saturday. Reason In the interests of the amenities of the occupiers of nearby dwellings. 07 All cooking fumes shall be exhausted from the building via a suitable extraction and filtration system. The ductwork to the extraction system shall terminate at least 1m above the eaves. All ductwork shall be 400mm diameter, low pressure class A and be constructed in accordance with HCVA specification DW/144(1) with a thickness of 0.8mm. The ductwork shall be capable of providing a minimum velocity of 8m/s. The canopy shall be capable of providing a minimum velocity of 0.35m/s. Prior to extraction to atmosphere, cooking odour shall pass through a grease filter (course filter), fine filter and activated carbon filter. The extraction/filtration system shall be effectively used at all times during cooking and be maintained and operated in accordance with the manufacturer’s specifications. Reason So as to ensure correct dispersion of cooking odours to avoid disamenity to the locality and in accordance with policy SP52 ‘Control of Pollution’. 08 Ductwork to the extraction system shall be mounted with support brackets with antivibration mountings. During operation, noise from the extraction system shall not exceed 5dB(A) below that of background noise level when measured 1m from the facade of the nearest noise sensitive premises. Reason In the interests of the amenities of the occupiers of nearby dwellings. 09 The onsite litter bin to the forecourt and arrangements for emptying shall be thereafter retained for the duration of the development. Reason In the interests of visual amenity and to reduce the problem of litter. 10 The approved landscape scheme (ref Site Plan 01628 MJ 03) shall be retained for the duration of the development. Reason To ensure that there is a well laid out scheme of healthy trees and shrubs in the interests of amenity. 11 The approved boundary treatment (ref Site Plan 01628 MJ 03) shall be retained for the duration of the development. Reason To provide an effective screen in the interests of amenity and in accordance with Core Strategy Policy CS28. 12 The approved cycling parking (ref Site Plan 01628 MJ 03) shall be retained for the duration of the development. Reason In order to promote sustainable transport choices. 13 No part of the land other than that occupied by buildings shall be used for the storage of goods, components, parts, waste materials or equipment. Reason To prevent the land from becoming unsightly in the interests of visual amenity and in accordance with Core Strategy Policy CS28. 14 The doors/gates on the bin stores hereby approved, shall be closed at all times except when the bins are being accessed/used. Reason To prevent the land from becoming unsightly in the interests of visual amenity and in accordance with Core Strategy Policy CS28. 15 The approved foul and surface water drainage (ref Site Plan 01628 MJ 03) shall be retained for the duration of the development. Reason To ensure that the development can be properly drained in accordance with Local Plan Policies. Positive and Proactive Statement Whilst the applicant did not enter into any formal pre application discussions with the Local Planning Authority, the proposals were in accordance with the principles of the National Planning Policy Framework and following clarifications regarding the application description did not require any alterations or modification.
