Reason In order to comply with the requirements of the Town and Country Planning Act 1990. 02 The permission hereby granted shall relate to the area shown outlined in red on the approved location plan and the development shall only take place in accordance with the submitted details and specifications and as shown on the approved plans Reason To define the permission and for the avoidance of doubt. 03 All plant and equipment shall be positioned as shown in the document: ‘CR3 Plant Layout, Drawing No: CR3-CBES-SWALLOWNEST, Rev B’, dated January 2025. Reason To safeguard the amenities of the occupiers of nearby properties in accordance with RMBC Policy SP52 and part 15 of the NPPF 04 The maximum sound levels of all fixed plant and equipment shall not exceed those specified in paragraph 4.3 of the Acoustic Impact Assessment of Proposed Fixed Plant, undertaken by Acoustic Control Engineers & Consultants, dated 18th February 2025 (Ref: B5776 2025- 02-18 R) and in document ‘CR3 Plant Layout, Drawing No: CR3-CBES-SWALLOWNEST, Rev B’, dated January 2025. Reason To safeguard the amenities of the occupiers of nearby properties in accordance with RMBC Policy SP52 and part 15 of the NPPF. 05 All air conditioning units shall only operate during daytime hours (07.00 – 23.00 hours) as indicated in paragraph 6.2 and Appendix 2 (Calculation Sheets) of the Acoustic Impact Assessment of Proposed Fixed Plant, undertaken by Acoustic Control Engineers & Consultants, dated 18th February 2025 (Ref: B5776 2025-02-18 R). Reason To safeguard the amenities of the occupiers of nearby properties in accordance with RMBC Policy SP52 and part 15 of the NPPF. Positive and Proactive Statement Whilst the applicant did not enter into any pre application discussions with the Local Planning Authority, the proposals were in accordance with the principles of the National Planning Policy Framework and did not require any alterations or modification.
