Conditions / Reason for Refusal: 01 The new residential lodge dwelling represents inappropriate development in the Green Belt, and would have a significant adverse impact on the openness of the Green Belt and the character of the area. It would lead to sprawl into the Green Belt and would be harmful to the spatial and visual openness of the Green Belt. The applicant has failed to demonstrate any very special circumstances to justify this inappropriate development and the harm caused to the openness of the Green Belt, and any other harm. As such, the proposal is considered to be contrary to Local Plan Policies CS4 ‘Green Belt’ and SP2 ‘Development in the Green Belt’ as well as the guidance contained within the National Planning Policy Framework (NPPF). 02 The design of the residential lodge being predominantly comprised of a wooden structure, along with the steel storage containers are considered to be of an unsatisfactory, utilitarian design and unsympathetic visual appearance which would be detrimental to the openness and visual appearance of the Green Belt and to the local character and distinctiveness of the area, contrary to Local Plan Policy SP55 ‘Design Principles’ and the design guidance in the NPPF. 03 The Council further considers that Battison Lane is inadequate to cater for additional pedestrian / vehicular traffic likely to be generated by the proposed use by virtue of its limited width and lack of separate pedestrian facilities such that the development, if implemented, would increase the potential for vehicular and vehicular / pedestrian conflict to the detriment of both road and pedestrian safety contrary to the NPPF. 04 A full Coal Mining Risk Assessment has not been submitted. The level of supporting detail is insufficient for the Coal Authority to make a comprehensive assessment of the risk of the development. The development is therefore contrary to Policy SP54 ‘Contaminated and Unstable Land’. Informative Enforcement action has been authorised requiring the demolition of the building, along with the removal of the 2 storage containers, and reinstatement of land for agricultural purposes with a compliance period of 6 months. POSITIVE AND PROACTIVE STATEMENT The applicant did not enter into any pre application discussions with the Local Planning Authority. It is not possible to support a scheme of this nature and no amendments have been identified at this time to make it acceptable. It was not considered to be in accordance with the principles of the National Planning Policy Framework and resulted in this refusal.
