Prior to the commencement of any overground development of Phase 4 as identified
on the Phase Plan WAV-PHP-01 samples of the materials to be used in this phase
shall be submitted and approved in writing by the Local Planning Authority. The
development shall thereafter be carried out in accordance with the approved
details/samples.

TRANSPORTATION/SUSTAINABILITY

As the development is brought into use, that part of the site to be used by vehicles shall be properly constructed with either
a/ a permeable surface and associated water retention/collection drainage, or
b/ an impermeable surface with water collected and taken to a separately
constructed water retention /discharge system within the site.
All to the satisfaction of the Local Planning Authority and shall thereafter be
maintained in a working condition.

To ensure that surface water can adequately be drained in accordance with Local

Before each dwelling is brought into use the car parking area associated with each dwelling as shown on the approved plan shall be provided, marked out and thereafter maintained for car parking.

To ensure the provision of satisfactory parking space and avoid the necessity for the
parking of vehicles on the highway in the interests of road safety.

The road sections, constructional and drainage details shall be implemented on site in accordance with the details approved in DOC application RB2023/0720.

Notwithstanding the provisions of the Town and Country Planning (General
Permitted Development) (England) Order 2015 (as amended) (or any Order revoking
and re-enacting that Order with or without modification) the car ports at plots 118,
124, 125, 126, 127, 133, 432, 438, 439, 440, 441 and 447 shall be made available
at all times for car parking purposes and no garage doors, gates, sides, walls,
extensions or other additions shall be fitted without the prior consent of the Local
Planning Authority.

GROUNDWATER/CONTAMINATION AND GROUND CONDITION

The foundation design for all new builds within the southern corner and north-eastern section of the site shall be implemented on site in accordance with the details approved in DOC application RB2023/0720.

The gas protection and mitigation measures approved in DOC application RB2023/720 shall be implemented on site and shall be installed by appropriately trained and qualified personnel.
Installation of the gas protection measures shall be verified for each plot which has not already been approved in DOC application RB2023/720, and in accordance with the pre-approved Detailed Design Report for Gas Mitigation Measures. A Verification Report shall be submitted to the Local Planning Authority to confirm that the measures constructed/installed meet the required standards.

Due to elevated sulphate concentrations being detected, buried concrete for the site
shall be designed to a design sulphate classification of DS-4 for made ground, with
a corresponding ACEC class of AC-4m. The design sulphate classification details approved in DOC application RB2023/0720 shall be used on site and shall be evidenced within a Verification Report for the site which shall be submitted to and
approved by the Local Planning Authority.

Suitable water supply pipes, sufficiently resistant to chemical attack from residual contaminants remaining in the ground as approved in DOC application RB2025/0720 shall be used at all development plots across the site and shall be evidenced within a Verification Report for the site which shall be submitted to and approved by the Local Planning Authority.

Subsoil/topsoil required to be imported to site for gardens or areas of soft Landscaping shall be in accordance with the details approved in DOC application RB2025/0720 and shall be evidenced within a Verification Report for the site which shall be submitted to and approved by the Local Planning Authority. This shall demonstrate that soils have been placed to a suitable depth across all plots and that chemical analysis confirms the soils are free from contamination and suitable for their intended use

If during development works unexpected significant contamination is encountered,
the Local Planning Authority shall be notified in writing immediately. Any requirements for remedial works shall be submitted to and approved in writing by the Local Planning Authority. Works thereafter shall be carried out in accordance with an approved Method Statement

Following completion of any remedial works at the site a Validation Report shall be submitted to and approved by the Local Planning Authority. This shall provide information on materials imported to site and placed in garden areas, to ensure suitable clean soils have been placed and to an appropriate depth. The report will also need to provide confirmation on water barrier pipes used, gas protection measures and the concrete design class used as noted above in conditions 12, 13, 14 & 15.
Each phase of development shall not be brought into use until
such time as all validation data has been approved by the Local Planning Authority.

ENVIRONMENTAL

No noise generating plant shall be installed in any part of the non residential
development until full and precise details have been submitted to and approved in
writing by the Local Planning Authority. The details shall include a
BS4142:2014+A1:2019 noise assessment and 1/3 octave frequency analysis with
appropriate corrections for acoustic features and shall detail any mitigation
measures, physical or operational to achieve no more than 0dB(A) above the
prevailing background levels, outside the boundary of the nearest noise sensitive
property during the quietest measured period. The approved details shall be
implemented on site.
Reason
To safeguard the amenities of the occupiers of nearby properties in accordance
with RMBC Policy SP52 and the NPPF

No commercial premises shall be occupied for the purpose of operating a food
business until an Odour Impact Assessment including the following information has
been submitted to and approved in full by the Local Planning Authority:
The report shall:
Determine the potential of adverse impact on neighbouring premises from the
odours associated with cooking;
Detail the necessary odour mitigation measures that are required to ensure the
occupiers of the nearby sensitive premises are not adversely affected by odours
associated cooking odour; and
Provided details of the proposed odour abatement system including positioning

supplied and transplanted in accordance with B.S. 4043.

Landscaping of the site in accordance with the approved plans for Conditions 21 and 24 above shall be carried out during the first available planting season after commencement of each phase of the development and thereafter maintained for the lifetime of the development. Any plants or trees which within a period of 5 years from completion of planting die, are removed or damaged, or that fail to thrive shall be replaced within the next planting season. Assessment of requirements for replacement planting shall be carried out on an annual basis in September of each year and any defective work or materials discovered shall be rectified before 31st December of that year.

WAV-PHP-01 details of a defibrillator and a life buoyancy aid to be provided on site

mains laying would be required to reach the nearest water main of suitable size and

developer should note abandoned 6 water main within boundary to eastern side of
the site.

This development is not subject to the statutory Biodiversity Gain Plan condition because of the declaration on the application form that the outline permission was granted before 20 February 2020 and was exempt.
POSITIVE AND PROACTIVE STATEMENT
During the determination of the application, the Local Planning Authority worked with the applicant to consider what amendments were necessary to make the scheme acceptable. The applicant agreed to amend the scheme so that it was in accordance with the principles of the National Planning Policy Framework.
