Reasons for refusal

The design and appearance of the dwelling as built materially harms the character and appearance of the Harthill Conservation Area in terms of its scale, massing, height and design contrary to Core Strategy Policies CS23 ‘Valuing the Historic Environment, CS28 ‘Sustainable Design’, SP55 ‘Design Principles’ and SP40 ‘Conservation Areas’ and the guidance in the NPPF.

The first and second floor windows on the property as built harm the residential amenity of neighbouring residents in terms of overlooking. As such the dwelling is contrary to Sites and Policy SP12 ‘Development on Residential Gardens’, and guidance contained within the NPPF.

Enforcement action has been authorised requiring the demolition of the building within a compliance period of 6 months from the date any Enforcement Notice comes into effect.
POSITIVE AND PROACTIVE STATEMENT
The applicant did not enter into any pre application discussions with the Local Planning Authority. It is not possible to support a scheme of this nature and no amendments have been identified at this time to make it acceptable. It was not considered to be in accordance with the principles of the National Planning Policy Framework and resulted in this refusal.
