The Council considers that the proposed two storey rear extension due to its projection and proximity to the boundary of No. 15 Yew Tree Close and by virtue of its distance of 7.15metres to from a habitable room window to neighbouring dwelling no. 10 Oakgrove boundary would be significantly detrimental to the amenity of the nearest neighbouring properties by way of overlooking and overbearing impact. It is therefore contrary to the NPPF, policies CS28 ‘Sustainable Design’ and SP55 ‘Design Principles’ of the Local Plan and the adopted Supplementary Planning Document - ‘Householder Design Guide’.
POSITIVE AND PROACTIVE STATEMENT
The applicant did not enter into any pre application discussions with the Local Planning Authority. Discussions during the determination of the application have identified that it is not possible to support a scheme of this nature nor would any amendments make it acceptable. It was not considered to be in accordance with the principles of the National Planning Policy Framework and resulted in this refusal.
