Conditions / Reason for Refusal: 01 The permission hereby granted shall relate to the area shown outlined in red on the approved location plan and the development shall only take place in accordance with the submitted details and specifications and as shown on the approved plans – • Site Plan 246/WAV/MAJ/A3 • Proposed Elevations 19206-THP-XX-XX-DR-A_0001-P01 • Site Sections 19206-VL_L02B • Landscape Plan 19206-VL_L01B • Proposed Earthworks 7589-HJCE-XX-XX-DR-C-2011-P02 Reason To define the permission and for the avoidance of doubt. 02 The materials to be used in the construction of the external surfaces of the development hereby permitted shall be in accordance with the details provided in the submitted application form/detailed in the covering letter. The development shall thereafter be carried out in accordance with these details. Reason In order to ensure a satisfactory appearance in the interests of visual amenity. 04 The Construction Environmental Management Plan dated 23rd September 2022, and received via email on 1st March 2023 shall be implemented throughout the construction phase of the development hereby approved. Reason To safeguard the amenities of the occupiers of nearby properties and promote sustainable development in accordance with Part 15 of the NPPF and RMBC Policy SP52. 05 Prior to commencement of the retaining wall, proposals for planting pockets for façade greening of the retaining wall shall to be submitted to and approved in writing by the Local Planning Authority. Details shall include the following :- • Planting plans, and details of the planting pockets. • Planting schedule with details of the size, species and quantity of plants • Responsibility for maintenance and a schedule of operations. The approved details shall be implemented within a timescale agreed by the Local planning Authority. Reason To ensure that there is a well laid out scheme of planting in the interests of amenity and in accordance with Local Plan Policies. 06 Cut and fill earthworks at the site shall be undertaken in accordance with the details approved in application RB2023/0494. Reason To ensure the safe occupation of the site in accordance with Policy SP54 of the Local Plan and paragraph numbers 183 and 184 of the National Planning Policy Framework 07 If during development works unexpected significant contamination is encountered, the Local Planning Authority shall be notified in writing immediately. Any requirements for remedial works shall be submitted to and approved in writing by the Local Planning Authority. Works thereafter shall be carried out in accordance with an approved Method Statement. This is to ensure the development will be suitable for use and that identified contamination will not present significant risks to human health or the environment. Reason To ensure the safe occupation of the site in accordance with Policy SP54 of the Local Plan and paragraph numbers 183 and 184 of the National Planning Policy Framework 08 Following completion of any required remedial/ground preparation works a Verification Report should be submitted to and approved by the Local Planning Authority. The Verification Report shall include details of the remediation works and quality assurance certificates to show that the works have been carried out in full accordance with the approved methodology. Details of any post-remedial sampling and analysis to show the site has reached the required clean-up criteria shall be included in the Verification Report together with the necessary documentation detailing what waste materials have been removed from the site. The site shall not be brought into use until such time as all verification data has been approved by the Local Planning Authority. Reasons To ensure the safe occupation of the site in accordance with Policy SP54 of the Rotherham Local Plan and paragraph numbers 183 and 184 of the National Planning Policy Framework. 09 The timing of material to be exported shall be undertaken in accordance with the transport technical note ‘Waverley AMP Plots 6 & 7 Enabling Infrastructure and Earthworks Reserved Matters application’ dated 20th March 2025. Reason In the interest of Highway Safety. Informatives 01 Public Rights of Way The cycle path/bridal path (indicated just outside the application boundary by the orange line on the site location plan is, and must be, retained as part of the proposed development across its whole width. 02 The Coal Authority • SUDs It should be noted that where SUDs are proposed as part of the development scheme consideration will need to be given to the implications of this in relation to the stability and public safety risks posed by coal mining legacy. The developer should seek their own advice from a technically competent person to ensure that a proper assessment has been made of the potential interaction between hydrology, the proposed drainage system and ground stability, including the implications this may have for any mine workings which may be present beneath the site. • Mine Gas It should be noted that wherever coal resources or coal mine features exist at shallow depth or at the surface, there is the potential for mine gases to exist. These risks should always be considered by the LPA. The Planning & Development team at the Coal Authority, in its role of statutory consultee in the planning process, only comments on gas issues if our data indicates that gas emissions have been recorded on the site. However, the absence of such a comment should not be interpreted to imply that there are no gas risks present. Whether or not specific emissions have been noted by the Coal Authority, local planning authorities should seek their own technical advice on the gas hazards that may exist, and appropriate measures to be implemented, from technically competent personnel. Positive and Proactive Statement The applicant and the Local Planning Authority engaged in pre application discussions to consider the development before the submission of the planning application. The application was further amended during the application process. It was considered to be in accordance with the principles of the National Planning Policy Framework
