Reasons for refusal

The Council considers that the dormer window, by virtue of its scale and massing, and due to the orientation of the application site, will have a significant impact on the residential amenity of the adjoining occupiers at no.2 Acacia Avenue in terms of overshadowing and overbearing impact. The proposal is therefore contrary to Local Plan Policies CS28 ‘Sustainable Design’ and SP55 ‘Design Principles’, the advice set out in the Council’s Supplementary Planning Document, and the guidance in the National Planning Policy Framework.

The Council further considers that the addition of the dormer window to the rear would be harmful to the character and appearance of the host property and the streetscene when viewed from Acacia Avenue. Accordingly, the proposal is contrary to Local Plan Policies CS28 ‘Sustainable Design’ and SP55 ‘Design Principles’, the advice set out in the Council’s Supplementary Planning Document, and the guidance in the National Planning Policy Framework.

Enforcement action has been authorised requiring the removal of the dormer window and the roof re-roofed with a compliance period of 6 months. Appropriate action should be taken to avoid formal enforcement action.
POSITIVE AND PROACTIVE STATEMENT
The applicant did not enter into any pre application discussions with the Local Planning Authority. It is not possible to support a scheme of this nature and no amendments have been identified at this time to make it acceptable. It was not considered to be in accordance with the principles of the National Planning Policy Framework and resulted in this refusal.
