Conditions / Reason for Refusal: 01 The Council considers that insufficient information and justification has been submitted to support the applicant’s claim that there is an established agricultural use taking place on the site and that the proposed building will be used in association with any such established use. The development therefore represents inappropriate development in the Green Belt and, by way of its size and location, has a materially adverse effect on the openness of the Green Belt and would lead to an unacceptable level of encroachment, harming the visual amenity and character in this location. No very special circumstances have been demonstrated to overcome the harm caused by the inappropriate development, and other harm caused, and consequently the proposal is in conflict with Policies SP2 and SP7 of the adopted Local Plan as well as the guidance contained within the NPPF. 02 The site lies within a Coal Authority Development High Risk Area and contains multiple recorded mine entries and historic shallow coal workings. The Coal Authority has objected to the application on the grounds that the proposed building may lie within the zone of influence of recorded mine shafts, posing a risk to ground stability and public safety. In the absence of intrusive site investigations and a revised layout demonstrating avoidance of these features, the application fails to demonstrate that the site can be safely developed. The proposal is therefore contrary to paragraphs 183, 187 and 188 of the National Planning Policy Framework (2024) and Policy SP62 of the Rotherham Local Plan (2018).
