Conditions / Reason for Refusal: 01 The development hereby permitted shall be commenced before the expiration of three years from the date of this permission. Reason In order to comply with the requirements of the Town and Country Planning Act 1990. 02 The permission hereby granted shall relate to the area shown outlined in red on the approved site plan and the development shall only take place in accordance with the submitted details and specifications as shown on the approved plans (as set out below) Amended Proposed Elevations and Floor Plans (2025-51-2A) (Received 03/03/2025) Reason To define the permission and for the avoidance of doubt. 03 The use hereby approved shall only operate between the following hours: 16:00 – 23:30 Sunday – Thursday 16:00 – 00:45 Friday – Saturday Reason To safeguard the amenities of the occupiers of nearby properties in accordance with RMBC Policy SP52 and part 15 of the NPPF. 04 Any shutters shall be internal only and no additional external shutters shall be mounted to the new shop front. Reason In the interest of the character of the area. 05 All cooking fumes shall be exhausted from the building via an extraction system which as a minimum shall include grease filters, electrostatic precipitator (ESP), and ozone injection, in order to reduce cooking odours. Ducting shall terminate at a minimum of 1m above the eaves of the building and air shall be extracted at a minimum velocity of 10m/s. The extraction/filtration system shall be operated whenever the cooking of food is undertaken and shall be maintained in accordance with the manufacturer’s specifications. Reason To safeguard the amenities of the occupiers of nearby properties in accordance with RMBC Policy SP52 and parts 12 & 15 of the NPPF.
