Planning permission for the erection of two dwellings and the remodelling of existing garage on the site has been approved and commenced, and development on the site is subject to the conditions attached to that permission (RB2018/1534). Whilst the development that has taken place differs from that approved, the differences could be dealt with by way of a Section 73 Variation of Condition application, and not require a full planning application. Conditions attached to that permission require the provision of a flood alleviation area, which would require the removal of all additional materials imported to site, over and above that allowed under the planning permission.

The caravan and mobile home on the site were lived in during construction of the approved dwellings, as allowed under per part 4, class A of the GPDO 2015. The houses have been built and are occupied and the mobile home and caravan should, therefore, be removed from the site in accordance with the GPDO.

The use of the site as a haulage yard has not been carried out on a continuous 10 year period, and irrespective of this, the planning permission for the two dwellings subsequently approved, and commenced, (RB2018/1534), does not allow for the use of any part of the site as a haulage yard.
