The development hereby permitted shall be commenced before the expiration of three years from the date of this permission.

The permission hereby granted shall relate to the area shown outlined in red on the approved site plan and the development shall only take place in accordance with the submitted details and specifications as shown on the approved plans (as set out below) except as shall be otherwise agreed in writing by the Local Planning Authority.

To define the permission and for the avoidance of doubt.

The proposed floodlighting columns shall be installed in accordance with the the Horizontal Luminance Levels calculations by Abacus Lighting Limited, dated 13th November 2024 (Ref: LS4066930b). The lighting shall not exceed the maximum Lux levels as detailed within the Horizontal Luminance Levels calculations and be maintained following installation and throughout the lifetime of the consent. The luminaires shall be suitably angled and if necessary shielded so as to prevent glare to sensitive receptors beyond the site boundary as per the guidance provided by the Institution of Lighting Professionals in their document ‘Guidance Note GN01/21 The Reduction of Obtrusive Light’.

To safeguard the amenities of the occupiers of nearby properties in accordance with RMBC Policy SP52 ‘Pollution Control’ and guidance contained within the NPPF.

The Floodlighting hereby approved shall not be operated between 21:00 hours and 09:00 hours.

This development is not subject to the statutory Biodiversity Gain Plan condition because of the declaration on the application form that the development was exempt because the impact on habitat is de-minimis.
Positive and Proactive Statement
Whilst the applicant did not enter into any pre application discussions with the Local Planning Authority, the proposals were in accordance with the principles of the National Planning Policy Framework and following highway clarifications did not require any additional alterations or modification.
