Conditions / Reason for Refusal: 01 The development hereby permitted shall be commenced before the expiration of three years from the date of this permission. Reason In order to comply with the requirements of the Town and Country Planning Act 1990. 02 The permission hereby granted shall relate to the area shown outlined in red on the approved site plan and the development shall only take place in accordance with the submitted details and specifications as shown on the approved plans (as set out below) (Amended Proposed Elevations, Floor Plans & Site Plan JBA.3548.601) Reason To define the permission and for the avoidance of doubt. 03 No more than 18 cats shall be boarded on site at any one time. Reason In the interests of highway safety. 04 The use hereby permitted shall only be open to customers for dropping off and collection between the hours of 07:00hrs and 17.30hrs Mondays to Sundays. Reason In the interest of neighbouring amenity. 05 The materials to be used in the construction of the external surfaces of the development hereby permitted shall be in accordance with the details provided in the submitted application form. The development shall thereafter be carried out in accordance with these details. Reason In order to ensure a satisfactory appearance in the interests of visual amenity. 06 The development shall be completed in accordance with the recommendations in Section 4.3 of Preliminary Bat Roost Assessment and Barn Owl Survey, Wildscapes, November 2024. All the recommendations shall be implemented in full according to the specified timescales, unless otherwise agreed in writing by the LPA, and thereafter permanently retained. Reason In the interest of protecting ecology 07 If the development is not commenced before the next bird breeding season (March – August), then an additional bird survey should be undertaken, submitted to and approved by the Local Planning Authority. Reason In accordance with the recommendations of the Wildscapes, November 2024 Ecology report, to protect nesting owls. 08 Before the development commences, details of the access / driveway improvements, consisting of a passing bay within the access, shall be submitted to and approved by the Local Planning Authority, and shall be carried out before the use of the building as a cattery facility is commenced. Reason In the interest of highway safety. POSITIVE AND PROACTIVE STATEMENT Whilst the applicant did not enter into any pre application discussions with the Local Planning Authority, the proposals were in accordance with the principles of the National Planning Policy Framework and did not require any alterations or modification.
