Conditions / Reason for Refusal: 01 The development hereby permitted shall be commenced before 16th February 2027 (three years from the date of the original permission). Reason In order to comply with the requirements of the Town and Country Planning Act 1990. 02 The permission hereby granted shall relate to the area shown outlined in red on the approved site plan and the development shall only take place in accordance with the submitted details and specifications and as shown on the approved plans (as set out below) Location Plan 21113-1009 Rev P01 Proposed Site Plan for Provision of Access Ramps 2449-3051 Proposed Ground Floor Layout 21113-1006 Rev P07 Proposed External Ramp Provision for Disabled Access & Fire Escapes 2449-3052 Proposed roofplan 21113-1011 Rev P03 Proposed Elevations and fencing details 21113-1003 Rev P08 (received 05.09.24). Reason To define the permission and for the avoidance of doubt. 03 The materials to be used in the construction of the external surfaces of the development hereby permitted shall be in accordance with the details shown on elevations (ref Proposed Site Plan for Provision of Access Ramps 2449-3051, Proposed External Ramp Provision for Disabled Access & Fire Escapes 2449-3052, Proposed Elevations and fencing details 21113-1003 Rev P08). The development shall thereafter be carried out in accordance with these details. Reason In order to ensure a satisfactory appearance in the interests of visual amenity and in accordance with Core Strategy Policy CS28. 04 Prior to the first use of the garden centre, details of the colour finish of the fencing shall be submitted and approved by the Local Planning Authority. The development shall thereafter be carried out in accordance with the approved details. Reason In order to ensure a satisfactory appearance in the interests of visual amenity and in accordance with Core Strategy Policy CS28. 05 The garden centre hereby approved as part of the development shall be ancillary to the use of the combined retail unit and shall not at any time be used as a separate trading unit. Reason To confirm the parameters of the permission and for the avoidance of doubt. The garden centre has been considered as an ancillary use and any potential re-subdivision of the unit in the future has not been considered in the sequential assessment detail submitted with this application. 06 Before the development is brought into use, that part of the site to be used by vehicles shall be constructed with either; a/ a permeable surface and associated water retention/collection drainage, or; b/ an impermeable surface with water collected and taken to a separately constructed water retention/discharge system within the site. The area shall thereafter be maintained in a working condition. Reason To ensure that surface water can adequately be drained and that mud and other extraneous material is not deposited on the public highway in the interests of the adequate drainage of the site, road safety and residential amenity. 07 Before the development is brought into use the car parking area shown on the submitted plan (ref Proposed Site Plan for Provision of Access Ramps 2449-3051) shall be provided, marked out and thereafter maintained for car parking. Reason In order to clarify the permission. 08 Before the proposed development is brought into use, a Travel Plan shall have been submitted to and approved by the Local Planning Authority. The plan shall include clear and unambiguous objectives, modal split targets together with a time bound programme of implementation, monitoring and regular review and improvement. The Local Planning Authority shall be informed of and give prior approval in writing to any subsequent improvements or modifications to the Travel Plan following submission of progress performance reports as time tabled in the programme of implementation. Reason In order to promote sustainable modes of transport.
