Conditions / Reason for Refusal: 01 The gates and fencing due to their design are considered to be inappropriate in the Harthill Conservation Area and harms the character and appearance of the Harthill Conservation Area and the general street scene. Furthermore, the applicant has failed to provide an analysis of the impact on the fencing on the designated heritage asset of the Harthill Conservation Area, and no public benefit from the proposals has been demonstrated to overcome the less than substantial harm caused. As such the proposal would be contrary to Core Strategy Policies CS23 ‘Valuing the Historic Environment’ and CS28 ‘Sustainable Design’, as well as SP41 ‘Conservation Areas’ and SP43 ‘Conserving and Recording the Historic Environment’ and guidance contained in the NPPF. Informative Enforcement action has been authorised requiring the removal of all the fence panels and gate to the front of 76 Union Street within a compliance period of 3 months. You must now remove the fencing and gate as the Council will look to serve an Enforcement Notice to remove the fence and wall imminently. POSITIVE AND PROACTIVE STATEMENT The applicant engaged with the Council prior to the submission of this application during the enforcement process. During the determination of the application, it was identified that it is not possible to support a scheme of this nature nor would any amendments make it acceptable. It was not considered to be in accordance with the principles of the National Planning Policy Framework and resulted in this refusal.
