The Council considers that the applicant has failed to provide sufficient evidence to demonstrate, that on the balance of probability, the use of the land for a car repair and dismantling business has been in place on a continuous basis for ten years prior to the submission of the current application. As such the Local Planning Authority is not satisfied that the use as described above is lawful.
(B) That the Chairman and Vice Chairman in conjunction with the Director of Planning Service, authorise the service of an Enforcement Notice under Section 172 of the Town and Country Planning Act 1990, on the OWNER / OCCUPIER of, and anyone else having an interest in, the land at 60 Claypit Lane, Rawmarsh, requiring the cessation of the use of the land within 7 days and the removal of all storage and equipment associated with the car repair use within 3 months, and subsequent prosecution should the requirement s of the notice not be carried out within these timescales.
