Conditions / Reason for Refusal: 01 The development hereby permitted shall be commenced before the expiration of three years from the date of this permission. Reason In order to comply with the requirements of the Town and Country Planning Act 1990. 02 The permission hereby granted shall relate to the area shown outlined in red on the approved location plan and the development shall only take place in accordance with the submitted details and specifications and as shown on the approved plans Location Plan – Sheet K11, received 15 February 2024 Proposed – Sheet K11, received 7 May 2024 Reason To define the permission and for the avoidance of doubt. 03 Prior to the building being first occupied glazing shall be provided and installed to all facades to achieve a minimum noise reduction criterion of 33 dB Rw+Ctr, as specified in Section 5.1.3 of the Noise Impact Assessment dated 17th April 2024 (Ref: P7261-R1-V1). The glazing shall thereafter be retained and maintained. Reason To safeguard the amenities of the future occupiers of the proposed 04 Prior to the building being first occupied a maximum of 1No. trickle ventilator shall be installed to each room to achieve a minimum noise reduction criteria of 35 dB Dne,w+Ctr, as specified in Section 5.1.3 of the Noise Impact Assessment dated 17th April 2024 (Ref: P7261-R1-V1). Where multiple trickle ventilators are required to be fitted in each room, revised noise calculations shall be provided in writing by a competent person to the Local Planning Authority for approval in order to demonstrate compliance with BS8233:2014, as detailed in Section 4.1.8 of the report. The trickle vents shall thereafter be retained and maintained. Reason To safeguard the amenities of the future occupiers of the proposed development. POSITIVE AND PROACTIVE STATEMENT During the determination of the application, the Local Planning Authority worked with the applicant to consider what amendments were necessary to make the scheme acceptable. The applicant agreed to amend the scheme so that it was in accordance with the principles of the National Planning Policy Framework.
