Conditions / Reason for Refusal: 01 The development hereby permitted shall be commenced before the expiration of three years from the date of this permission. The landscape scheme shall be based on approved BM3 Landscape Strategy Plans drawing no’s 71967/D900 rev C , 71967/D901 rev C, 71967/D902 rev C and prepared to a minimum scale of 1:200 and shall clearly identify through supplementary drawings where necessary: - A planting plan and schedule detailing the proposed species, siting, quality and size specification, and planting distances. - A written specification for ground preparation and soft landscape works. - The programme for implementation. - Written details of the responsibility for ongoing maintenance for the lifetime of the development and a schedule of operations. The scheme shall thereafter be implemented in accordance with the approved landscape scheme and in accordance with the appropriate standards and codes of practice within a timescale agreed, in writing, by the Local Planning Authority. Any plants or trees which within a period of 5 years from completion of planting die, are removed or damaged, or that fail to thrive shall be replaced within the next planting season. Assessment of requirements for replacement planting shall be carried out on an annual basis in September of each year and any defective work or materials discovered shall be rectified before 31st December of that year. Reason To mitigation for the loss of amenity resulting from the loss of the existing trees at the earliest opportunity. 04 Tree planting along the Highfield Spring and within Public open space areas shall comprise min. 18-20cms girth advanced nursery stock trees. As a minimum the trees shall be prepared, supplied and transplanted in accordance with B.S. 4043. Reason To mitigation for the loss of amenity resulting from the loss of the existing trees and in order to provide a degree of positive visual amenity at the earliest opportunity. 05 Before any works to form the development platform commence on site, details of a scheme of planting to provide screen planting to the Noise Bund shall be submitted to and approved in writing by the Local Planning Authority. The said planting shall include 25% feathered trees in additional to whips and transplants and shall thereafter be implemented in accordance with the approved details: i. Prior to the first occupation of the part or phase of development to which the screen relates: or ii. In accordance with an implementation timetable agreed in writing with the Local Planning Authority. This planting shall be maintained for the lifetime of the development and any failures replaced in accordance with the Mitigation Planting condition. Reason To mitigation for noise and to provide a degree of positive visual amenity at the earliest opportunity. 06 A landscape management plan, including long term design objectives, management responsibilities and maintenance schedules for all landscape and public realm areas shall be submitted to and approved by the Local Planning Authority prior to the completion or first occupation of the part or phase of development to which it relates, whichever is the sooner. The management shall thereafter be carried out in accordance with the agreed management scheme. Reason To ensure that due regard is paid to the continuing enhancement and maintenance of amenity afforded by landscape features of communal, public and biodiversity significance. 07 Before any trees are felled on site details of the Re-Use of felled trees and Reduction of Carbon Loss shall be submitted to the Local Planning Authority for approval. No felled trees shall be removed from site until the details have been approved, and the approved details shall be implemented. Reason In an efforts to reduce carbon loss and in accordance with Local Plan Policies CS20 Biodiversity and Geodiversity and Policy CS28 Sustainable Design. 08 No trees within Woodland Group G3 shall be felled until details of the Re-Use of Saplings from the Group, and a timetable for their Re-Use have been submitted to and approved by the Local Planning Authority. The approved details shall be implemented on site in accordance with the approved timetable. Reason To allow for the Re-Use of the saplings in an effort to reduce carbon loss in accordance with Local Plan Policies CS20 Biodiversity and Geodiversity and Policy CS28 Sustainable Design. 09 Within 3 months of the date of this permission a Tree Replacement Strategy in line with Tree replacement Plan PD4-RG-M-04 Rev B received on 22-07-2024 shall be submitted to and approved in writing by the Local Planning Authority. The Strategy shall include details of the following – • Replacement Planting Plan to include - - A site plan showing the outline and size of each tree planting location - A planting plan and schedule detailing the proposed species, siting, quality and size specification, and planting distances, for each location - Comprehensive details of ground/tree pit preparation to include: - Plans detailing adequate soil volume provision to allow the trees to grow to maturity. - Staking/tying and protection method(s). - The programme for implementation. - Five-year post planting maintenance and inspection schedule to include management of competing vegetation, replacement planting of failed trees, watering, checks and adjustments of tree support and protection and any formative pruning that would be beneficial. - 30 year reporting and minimal management schedule to be agreed for the scrub succession areas • Ongoing Management and Maintenance of Replacement Planting Areas The approved details within the Tree Replacement Strategy shall be implemented on site, and the areas shall be managed and maintained in accordance with the approved details. Reason To ensure that there is a well laid out scheme of healthy trees and shrubs in the interests of amenity, eco-system services and nature recovery and in accordance with Local Plan Policies CS19: Green Infrastructure, CS20 Biodiversity and Geodiversity, Policy CS21 Landscape, Policy CS28 Sustainable Design. 10 The development shall be undertaken in accordance with the details outlined in the submitted document by RSK Geosciences detailing the proposed coal mining legacy site investigation strategy ref 350567/LO2/jh dated 30th Jan 2024. Reason In the interest of safety and land stability 11 Notwithstanding the submitted details, before works to form the development platform commence a scheme for biodiversity enhancement, such as the incorporation of permanent bat roosting feature(s), hedgehog homes and nesting opportunities for birds, shall be submitted to and agreed in writing with the Local Planning Authority. The approved details thereafter shall be implemented, retained and maintained for their designed purpose in accordance with the approved scheme. The scheme shall include, but not limited to, the following details: i. Description, design or specification of the type of feature(s) or measure(s) to be undertaken; ii. Materials and construction to ensure long lifespan of the feature/measure iii. A drawing(s) showing the location and where appropriate the elevation of the features or measures to be installed or undertaken. iv. When the features or measures will be installed within the construction, occupation, or phase of the development. Reason In the interest of biodiversity 12 No removal of hedgerows, trees or shrubs shall take place between 1st March and 31st August inclusive, unless a competent ecologist has undertaken a careful, detailed check of vegetation for active birds’ nests immediately before the vegetation is cleared and provided written confirmation that no birds will be harmed and/or that there are appropriate measures in place to protect nesting bird interest on site. Any such written confirmation should be submitted to the local planning authority. Reason In the interest of biodiversity 13 The details shown on plan reference PLOT 4D FOUL AND SURFACE WATER STRATEGY WR4D TTE 00 XX DR C 101 P02 & PLOT 4D CONNECTION DETAIL WR4D TTE 00 XX DR C 109 MH SW-F-7 shall be implemented on site in line with the Ordinary Watercourse Land Drainage Consent Approval submitted via email on 16th May 2024. Reason In the interest of satisfactory drainage of the site 14 All cut and fill earthworks shall be carried out under the approved Materials Management Plan (MMP). Following the completion of earth movements, a Verification Report shall be submitted to the Local Planning Authority for review and comment, confirming that all earthworks have been undertaken in accordance with the MMP. Reason To ensure the safe occupation of the site in accordance with Policy SP54 of the Rotherham Local Plan and paragraph numbers 189 and 190 of the National Planning Policy Framework. 15 If during development works unexpected significant contamination is encountered, the Local Planning Authority shall be notified in writing immediately. Any requirements for remedial works shall be submitted to and approved in writing by the Local Planning Authority. Works thereafter shall be carried out in accordance with an approved Method Statement. 16 The works shall be carried out in accordance with the Bentley Project Management Plan Version 1.7 dated 29th April 2024. Reason In the interest of highway safety and residential amenity Informatives 01 Landscape A Management Plan may be expected to set out, graphically and / or in writing, the overall functional and aesthetic objectives of a landscape scheme and the steps such as legal arrangements including ownership and management responsibilities, planned maintenance tasks, phased works, and monitoring procedures that will be taken after implementation to ensure that the scheme establishes successfully and is sustainable in the long-term. 02 The Coal Authority Under the Coal Industry Act 1994 any intrusive activities, including initial site investigation boreholes, and/or any subsequent treatment of coal mine workings/coal mine entries for ground stability purposes require the prior written permission of The Coal Authority, since such activities can have serious public health and safety implications. Failure to obtain permission will result in trespass, with the potential for court action. Application forms for Coal Authority permission and further guidance can be obtained from The Coal Authority’s website at: www.gov.uk/get-a-permit-to-deal-with-a-coal-mine-on-your-property. 03 Network Rail As the works involve alterations to the ground profile in close proximity to the live railway the Asset Protection Team should be contacted to run through the proposals and enter into a basic asset protection agreement to cover development working adjacent to the railway. It must be pointed out that actions which cause disruption or damage to the safe running of trains is a criminal offence.
