Decision Date: 05 April 2024
Decision Type: REFUSED
Temporary Expiry Date:
Decision Level/Committee: Proposed to be Delegated
Conditions / Reason for Refusal: 01 It is not considered that the proposed development would be responsive to its context in this backland location or positively contribute to the local character and distinctiveness of the area and the way it functions, contrary to Local Plan Policies CS28 ‘Sustainable Design’ and SP55 ‘Design Principles’. 02 The proposed parking spaces are considered to be substandard in size and the access is considered to be of inadequate width to accommodate two way traffic with no pedestrian intervisibility which would be detrimental to pedestrian and road safety. 03 There is a lack of information in the form of Noise and Odour reports to assess whether appropriate mitigation could be taken to minimise the impact of the existing commercial environment on future residents of the proposed apartments. 04 There is a lack of information in the form of a Tree Survey and Ecology report to assess whether appropriate mitigation could be taken to address the impact of the proposed development on trees and general ecology on the site. As such the application would be in conflict with adopted Local Plan Policies CS19 ‘Green Infrastructure’, CS20 ‘Biodiversity and Geodiversity’, CS21 ‘Landscape’, SP32 ‘Green Infrastructure and Landscape’ and SP33 ‘Conserving the Natural Environment’, as well as the National Planning Policy Framework. POSITIVE AND PROACTIVE STATEMENT The applicant did not enter into any pre application discussions with the Local Planning Authority. It is not possible to support a scheme of this nature and no additional information has been submitted to address the concerns raised to make it acceptable. It was not considered to be in accordance with the principles of the National Planning Policy Framework and resulted in this refusal.
