Site Address: Ron Hull Junior Ltd Mangham Road Parkgate 9999
Description: Change of use of land for additional surface storage for use by adjoining recycling centre
Officer Recommendation: WITHDRAWN
Officer Recommendation Date: 10 February 2025
Decision Date: 10 February 2025
Decision Type: WITHDRAWN
Temporary Expiry Date:
Decision Level/Committee: Delegated (Part 2B)
Conditions / Reason for Refusal: 01 The proposed industrial/commercial development of this site would be premature at this time until the Bassingthorpe Farm’ Strategic Allocation masterplan has been agreed, including which areas suitable for industrial/commercial development have been established. As such the proposal is contrary Local Plan Policy CS1 ‘Delivering Rotherham’s Spatial Strategy’. 02 The Council further considers that the application has an insufficient level of detailed information for the volume and type of storage proposed, along with details of any on site equipment and machinery being used. No detailed noise assessment or assessment of on site processes to mitigate noise and dust suppression methods has been supplied. In addition no Transport Assessment (TA) has been supplied to demonstrate the impact on the surrounding highway network. Accordingly, the Council does not consider that the applicant has submitted sufficient evidence to demonstrate that the site can operate in accordance with Local Plan Policy CS14 ‘Accessible Places and Managing Demand for Travel, SP26 ‘Sustainable Transport for Development’ and SP52 ‘Pollution Control’. 03 The Council considers that the use of this substantial and prominent site for open storage would have a significant detrimental impact on the surrounding character of the area from a visual amenity perspective which would directly conflict with policies SP55 Design Principles and CS28 Sustainable Design as well as the general advice within the NPPF. INFORMATIVE Please note enforcement action has been authorised to secure the cessation of any commercial activities and the removal of any plant and machinery along with the stockpiles of materials at the site. Where the Enforcement Notice is not complied with within the relevant timescales, Prosecution action has been authorised. Please can you ensure that appropriate steps are taken so as to avoid formal enforcement action. POSITIVE AND PROACTIVE STATEMENT The applicant did not enter into any pre application discussions with the Local Planning Authority. Discussions during the determination of the application have requested additional information and clarifications along with a suggested decrease in site area. However no detailed information has been submitted in support of the scheme and the original submission was requested for determination. This was not considered to be in accordance with the principles of the National Planning Policy Framework and resulted in this refusal. (B) That enforcement action be authorised in order to secure the cessation of any commercial activities and the removal of any plant and machinery along with the stockpiles of materials at the site, with a compliance period of 6 months. It is also recommended that, where the Enforcement Notice is not complied with within the relevant timescales, Prosecution action be authorised.
