Conditions / Reason for Refusal: 01 The permission hereby granted shall relate to the area shown outlined in red on the approved site plan and the development shall only take place in accordance with the submitted details and specifications and as shown on the approved plans (as set out below) (Drawing numbers Location Plan – Drawing 23006-LP-002; Proposed Site Plan 1:500 – Drawing Number 23006-PP-003; Proposed Site Plan 1:200 – Drawing Number 23006-PP-004; 132 kV Substation Compound – Drawing Number CEL-STD-SUB-248; Tesla Megapack Battery Storage Unit – Drawing Number CEL-STD-BATT-371; NPG Substation Control and Metering Room – Drawing Number CEL-STD-NPG-SUB-250; CCTV Column – Drawing Number CEL-STD-CCTV-307; Metal Palisade Security Fence – Drawing Number CEL-STD-PF-G-700; Switch Room – Drawing Number CEL-STD-SW-130; Auxiliary Transformer – Drawing Number CEL-STD-TX-160-A; Preliminary Ecological Appraisal; Flood Risk and Drainage Strategy; Noise Impact Assessment; Swept Path highway plan 23006-PP-SPA-005 (received 18 April 2023, 9 May 2023). Reason To define the permission and for the avoidance of doubt. 02 No part of the land other than that occupied by buildings shall be used for the storage of goods, components, parts, waste materials or equipment without the prior written approval of the Local Planning Authority. Reason To prevent the land from becoming unsightly in the interests of visual amenity and in accordance with Core Strategy Policy CS28 Sustainable Design. 03 The structures hereby approved shall be wholly removed and the site restored in a manner to be agreed with the Local Planning Authority, once they reach the end of their usable life. Reason To ensure the site does not become derelict and unsightly once it is no longer required, in accordance with Core Strategy Policies CS4 Green Belt and CS28 Sustainable Design. 04 Before the development is brought into use, that part of the site to be used by vehicles shall be constructed with either; a/ a permeable surface and associated water retention/collection drainage, or; b/ an impermeable surface with water collected and taken to a separately constructed water retention/discharge system within the site. The area shall thereafter be maintained in a working condition. Reason To ensure that surface water can adequately be drained and to encourage drivers to make use of the parking spaces and to ensure that the use of the land for this purpose will not give rise to the deposit of mud and other extraneous material on the public highway in the interests of the adequate drainage of the site and road safety. Drainage 05 No above ground works shall begin until details of the foul, surface water and land drainage systems and all related works necessary to drain the site have been submitted to and approved by the Local Planning Authority. These works shall be carried out concurrently with the development and the drainage system shall be operating to the satisfaction of the Local Planning Authority prior to the operation of the development. Reason To ensure that the site is connected to suitable drainage systems and to ensure that full details thereof are approved by the Local Planning Authority before any works begin and in accordance with Policy CS25 of the Local Plan. Noise Assessment 06 Only plant of the quantities and specifications detailed in Section 5.1, Table 6 (Page 16) of the Noise Impact Assessment undertaken by Inacoustic, dated 17th March 2023 (Project No: 22-280) shall be installed on site. Maximum Sound Power Levels (LWA) for plant shall not exceed those specified within Table 6. Reason To safeguard the amenities of the occupiers of the proposed development in accordance with RMBC Policy SP52 and parts 12 and 15 of the NPPF. Fencing details 07 Prior to any above ground works take place, a plan indicating the positions, design, materials and type of boundary treatment to be erected or changed shall be submitted to and approved in writing by the Local Planning Authority. Reason In order to ensure a satisfactory appearance in the interests of visual amenity and in accordance with Core Strategy Policy CS28. 08 Prior to any above ground works, details of the boundary treatment to the front of the site bounding Rawmarsh Road including retention/removal of the boundary wall and any additional/new fencing shall be submitted to and approved in writing by the Local Planning Authority. The approved boundary treatment shall be completed within a time frame to be agreed by the Local Planning Authority. Reason In order to ensure a satisfactory appearance in the interests of visual amenity and in accordance with Core Strategy Policy CS28. Informative(s) The applicant is reminded that only the area within the red-edge site plan has been considered in this planning application. Any potential encroachment into the shared site area to the north west of the site from the earlier installed fence would be a civil issue between the applicant and the landowner. Positive and Proactive Statement Whilst the applicant did not enter into any pre application discussions with the Local Planning Authority, the proposals were in accordance with the principles of the National Planning Policy Framework and following highway and fencing clarifications did not require any further alterations or modification.
