Planning Application Number: RB2023/0522
Site Address: land adj 18 Main Street North Anston 9999
Description: Erection of 3No residential dwellings and associated works
Officer Recommendation: REFUSED
Officer Recommendation Date: 01 September 2023
Decision Date: 01 September 2023
Decision Type: REFUSED
Temporary Expiry Date:
Decision Level/Committee: Proposed to be Delegated
Conditions / Reason for Refusal: 01 The Council considers that the proposed parking areas have the potential to harm the trees on the site, which would be significantly detrimental to the visual amenity of the North Anston Conservation Area. Furthermore, the siting of the proposed parking areas would lead to pressure for the pruning or removal of the trees on the site to the detriment of their visual amenity and that of the locality. As such, the proposed development is contrary to Local Plan Policies SP34 ‘Nature Conservation’ and SP41 ‘Conservation Areas’ as well as guidance in the NPPF. 02 The proposed vehicular access to the site is considered to be unsuitable to cater for the additional vehicular traffic likely to be generated by virtue of the severely restricted visibility at the junction with Main Street where the driver of a vehicle leaving the site must emerge into the highway before an acceptable degree of visibility is available. This would be significantly detriment to road safety and contrary to NPPF 111 which seeks to ensure developments do not impact on highway safety. 03 The proposed parking for plot 1 is substandard in terms of aisle width resulting In access into / out of the space being very difficult, if not impossible for an average family car. The proposed parking provision does not comply with the Councils minimum Car Parking Standards for residential development and would not adequately accommodate the level of likely parking demand. 04 The applicant has failed to provide information that demonstrates no net loss of biodiversity at the site before and after development has taken place. As such, the proposal is contrary to the requirements of Local Plan Policy SP33 ‘Conserving and Enhancing the Natural Environment’ 05 The application has not been supported by Archaeological desk based assessment and therefore a full impact on archaeology cannot be fully assessed. As such the scheme is contrary to Local Plan Policies CS23 ‘Valuing the Historic Environment’, SP42 ‘Archaeology and Scheduled Ancient, Monuments’ SP43 ‘Conserving and Recording the Historic Environment’ and the NPPF. POSITIVE AND PROACTIVE STATEMENT Whilst the applicant entered into pre application discussions with the Local Planning Authority these identified that it is not possible to support a scheme of this nature and no amendments have been identified at this time to make it acceptable. The application was submitted on the basis of these discussions and later amended and it was not considered to be in accordance with the principles of the National Planning Policy Framework resulting in this refusal.
