Rotherham Metropolitan Borough Council Council Online Planning - Decision Notice Summary

Planning Application Number: RB2023/0517
Site Address: 177 Swinston Hill Road Dinnington 0177
Description: Erection of 2.5m boundary fence
Officer Recommendation: REFUSED
Officer Recommendation Date: 02 June 2023
Decision Date: 02 June 2023
Decision Type: REFUSED
Temporary Expiry Date:
Decision Level/Committee: Delegated (Part 2B)
Conditions / Reason for Refusal: Reasons for refusal 01 The proposed fencing by virtue of its height, length, siting and appearance to the front of the property in a prominent position has introduced an incongruous feature which is clearly visible within the street scene and is detrimental to the appearance of the host property, as well as the streetscene and character of the area in general. As such the development is contrary to Local Plan Policies CS28 ‘Sustainable Development’ and SP55 ‘Design Principles’, as well as the Council’s SPD ‘Householder Design Guide’ and the guidance in the National Planning Policy Framework and the National Planning Practice Guidance. Informative Enforcement action has been authorised requiring the removal of 4 panels and associated concrete posts which front Swinston Hill Road and enclose the driveway and garage area to the west of the access drive, and 9 fence panels and associated concrete posts on the Swinston Hill Road frontage and returning to the property itself to the east of the access drive, within a compliance period of 3 months. The 9 panels which run parallel with Brands Lane can be retained. Appropriate action should be taken to secure the removal of the fence panels and concrete posts to avoid formal enforcement action. Positive and Proactive Statement The applicant did not enter into any pre application discussions with the Local Planning Authority. Discussions during the determination of the application have identified that it is not possible to support a scheme of this nature nor would any amendments make it acceptable. It was not considered to be in accordance with the principles of the National Planning Policy Framework and resulted in this refusal.
