The extension of the garden area reduces the width of the access at this point, incorporating the detached garage on the extended section of land. This restricts the potential development of Housing Site H52, contrary to Local Plan Policy CS1 ‘Delivering Rotherham’s Spatial Strategy’ and Policy SP1 ‘Sites Allocated for Development’ as well as the guidance contained at paragraphs 60 and 68 of the NPPF

Enforcement action has been authorised requiring the removal of the outbuilding and the cessation of the use of the extended area as garden, and reinstatement of the original boundary to the front of 43 Wentworth Gardens, all within a compliance period of 6 months.
POSITIVE AND PROACTIVE STATEMENT
The applicant did not enter into any pre application discussions with the Local Planning Authority. It is not possible to support a scheme of this nature and no amendments have been identified at this time to make it acceptable. It was not considered to be in accordance with the principles of the National Planning Policy Framework and resulted in this refusal.
