| Conditions / Reason for Refusal: |
01
The Council considers that the proposal if implemented, would introduce a further point of potentially conflicting vehicle movements into a busy A618 Moorgate Road to the detriment of the free and safe flow of other traffic, and thereby conflicting with Sites and Policies SP11 ‘Development in Residential Areas’, Supplementary Planning Guidance – Householder Design Guide and advice within the NPPF which seeks to permit only proposals that make adequate arrangements for the parking and manoeuvring of vehicles associated with the development.
02
The Council further considers that the formation of a vehicular access at this location is likely to have an adverse effect on the future prospect of trees T21 & T22 of Tree Preservation Order No. 1, 1978, which provide valuable and important amenity within this part of the Moorgate Conservation Area and are adjacent to the busy and important transport corridor to and from Rotherham Town Centre. As such the proposal is contrary with both Sites and Policies SP41 ‘Conservation Areas’ and SP33 ‘Conserving and Enhancing the Natural Environment’
Positive and Proactive Statement
The applicant did not enter into any pre application discussions with the Local Planning Authority. Discussions during the determination of the application have identified that it is not possible to support a scheme of this nature nor would any amendments make it acceptable. It was not considered to be in accordance with the principles of the National Planning Policy Framework and resulted in this refusal.
