Conditions / Reason for Refusal: 01 The development hereby permitted shall be commenced before the expiration of three years from the date of this permission. Reason In order to comply with the requirements of the Town and Country Planning Act 1990. 02 The permission hereby granted shall relate to the area shown outlined in red on the approved site plan and the development shall only take place in accordance with the submitted details and specifications and as shown on the approved plans (as set out below) (Drawing numbers, 001 rev 2/S-02 rev 2/ S-03 rev 2/ S-04 rev 2/ S-05 rev 2/ S-06 rev 2/ S-07 rev 2/ S-08 rev 2/ S-09 rev 2)(received 11/05/2022) (Drawing number, 1 B)(received 10/09/2021) Reason To define the permission and for the avoidance of doubt. 03 Prior to the occupation of the dwellings hereby approved, details of the replacement windows, including their colour treatment, on the 1920s façade fronting Grove Road shall be submitted to and approved in writing with the Local Planning Authority. These windows shall be of a like for like appearance and constructed of timber unless otherwise agreed in writing with the Local Planning Authority. The development shall proceed in accordance with the approved details. Reason To protect the character and appearance of the Rotherham Town Centre Conservation Area in accordance with Local Plan Policy, SP41 ‘Conservation Areas.’ 04 The replacement windows hereby approved on the 1960s extensions to the building shall have a coloured finish the details of which shall be submitted to and approved in writing with the Local Planning Authority. The development shall proceed in accordance with the approved details and shall thereafter be retained and maintained. Reason To protect the character and appearance of the Rotherham Town Centre Conservation Area in accordance with Local Plan Policy, SP41 ‘Conservation Areas.’ 05 Prior to first occupation, details of measures to facilitate the provision of gigabit-capable full fibre broadband for the development hereby approved, including a timescale for implementation, shall be submitted to and approved in writing by the Local Planning Authority. The development shall be carried out in accordance with the approved details. Reason In accordance with Local Plan Policy SP61 ‘Telecommunications’ and Chapter 10 of the NPPF. 06 Prior to the occupation of any dwelling hereby approved, details of vehicle charging points (minimum one point per car parking space) shall have been submitted to and approved by the Local Planning Authority. The development shall not be occupied until the approved charging points have been provided, and they shall thereafter be retained. Reason In the interests of sustainable development and air quality. 07 Prior to the occupation of the dwellings hereby approved, a scheme shall be submitted to and approved in writing by the Local Planning Authority detailing how the use of sustainable/public transport will be encouraged. The agreed details shall be implemented in accordance with a timescale to be agreed by the Local Planning Authority. Reason In the interests of sustainable transport choices. Positive and Proactive Statement During the determination of the application, the Local Planning Authority worked with the applicant to consider what amendments and additional information was necessary to make the scheme acceptable. The applicant agreed to amend the scheme and provide the additional information requested so that it was in accordance with the principles of the National Planning Policy Framework.
