Conditions / Reason for Refusal: 01 The Council considers that the extension and decking would have a significant impact on the living conditions of the occupiers of the nearby properties by increasing the capacity for customers and gatherings on the site frontage resulting in increased noise and disturbance, and no mitigation could be carried out to adequately reduce the adverse impact on local residents. Accordingly, the proposal is contrary to the aims of Local Plan Policies CS27 ‘Community Health and Safety’, SP11 ‘Development in Residential Areas’, and SP52 ‘Pollution Control’, as well as the requirements within the National Planning Policy Framework and the National Planning Policy Guidance. 02 It is considered that the café as extended along with the associated external seating area is not ancillary or complementary to the residential nature and function of the area, is larger than is required to meet the needs of local residents, and does not benefit the health and well-being of the local population, contrary to Local Plan Policy SP11 ‘Development in Residential Areas’. Informative Enforcement action has also been authorised requiring the removal of the already constructed extension and decking with a compliance period of 3 months. Appropriate action should be taken as soon as possible to avoid the Council serving a formal Enforcement Notice in this respect. POSITIVE AND PROACTIVE STATEMENT The applicant did not enter into any pre application discussions with the Local Planning Authority. It is not possible to support a scheme of this nature and no amendments have been identified at this stage to make it acceptable. It was not considered to be in accordance with the principles of the National Planning Policy Framework and resulted in this refusal.
