Conditions / Reason for Refusal: Consented works: • Mature Ash tree in rear garden of 5 Main Street, Ulley • Crown lift to remove lower branches not exceeding 80mm diameter up to a maximum of 4 metres from ground level • Crown thin 20% of upper crown (equivalent to 1 in 5 secondary or tertiary branches) • Removal of decking boards at base of tree trunk to create growing room of 50mm. • Pruning to BS3998 standard. 1. All tree works shall be carried out in accordance with British Standard 3998: 2010 and shall not exceed the consented works as described in the officer report above. 2. Please note the authorised works should be completed within 2 years of the decision notice otherwise a new application for consent to carry out any non-exempt tree work will be required. 3. Whilst Rotherham Metropolitan Borough Council does not object to the proposed works, for any tree that is owned by a third-party permission must first be sought from the tree owner to enter their land to carry out the works. Without receiving this permission anyone entering the land with the tree on it could be found to be trespassing. 4. Nature conservation protection under UK and EU legislation is irrespective of the planning system and the applicant should therefore ensure that any activity undertaken, regardless of the need for any planning consent, complies with the appropriate wildlife legislation. If any protected species are found on the site then work should halt immediately and an appropriately qualified ecologist should be consulted. For definitive information primary legislative sources should be consulted. Furthermore, vegetation removal should be undertaken outside of the bird breeding season, March to September inclusive. If any clearance work is to be carried out within this period, a nest search by a suitably qualified ecologist should be undertaken immediately preceding the works. If any active nests are present, work which may cause destruction of nests or, disturbance to the resident birds must cease until the young have fledged.
