Rotherham Metropolitan Borough Council Council Online Planning - Decision Notice Summary

Planning Application Number: RB2021/1182
Site Address: 60 Beaconsfield Road Broom 0060
Description: Formation of new raised patio and boundary fence
Officer Recommendation: REFUSED
Officer Recommendation Date: 05 August 2021
Decision Date: 05 August 2021
Decision Type: REFUSED
Temporary Expiry Date:
Decision Level/Committee: Delegated (Part 2A)
Conditions / Reason for Refusal: 01 The Council considers that the raised patio by virtue of its height and location results in overlooking and a loss of privacy to the occupiers of the adjacent property at No.62 Beaconsfield Road. In addition the screening that has been installed on the boundary with No.62 Beaconsfield Road appears overbearing, bearing in mind the ground level difference between the two properties, and as such the proposed development would be detrimental to the amenities of the occupiers of this neighbouring property contrary to the National Planning Policy Framework, Local Plan Policy SP55 Design Principles and the Council’s adopted SPD ‘Householder Design Guide’. 02 The screen retaining wall facing No.62 Beaconsfield Road by way of its breeze block construction represents a poor standard of design not in accordance CS28 ‘Sustainable Design’ and SP55 ‘Design Principles’ and the design aims of the NPPF. Informative 01 Enforcement action has also been authorised requiring the removal of the patio in its entirety along with the boundary screening and that the land is returned to its former level and condition, within a compliance period of 3 month. Appropriate action should be taken as soon as possible to avoid the Council serving a formal Enforcement Notice in this respect. POSITIVE AND PROACTIVE STATEMENT The applicant did not enter into any pre application discussions with the Local Planning Authority. It is considered that it is not possible to support a scheme of this nature and whilst an alternative, reduced sized patio area has been suggested, the applicant is unwilling to amend the proposals. It was not considered to be in accordance with the principles of the National Planning Policy Framework and resulted in this refusal.
