Rotherham Metropolitan Borough Council Council Online Planning - Decision Notice Summary

Planning Application Number: RB2019/1746
Site Address: Vicarage Christchurch Road Wath-upon-Dearne 9999
Description: Application to undertake works to a tree(s) protected by RMBC TPO No. 10, 1975
Officer Recommendation: PART GRANT PART REFUSED
Officer Recommendation Date: 11 December 2019
Decision Date: 13 December 2019
Decision Type: PART GRANT PART REFUSED
Temporary Expiry Date:
Decision Level/Committee: Delegated (Part 2A)
Conditions / Reason for Refusal: Consented Works: ? T40 There is no objection to the removal of T40. Multiple cavities are present on the main stem of the tree, increasing the possibility of full or partial failure. The tree has been supressed by larger adjacent trees resulting in poor form. Its removal will not have a significant impact on the amenity of the area. ? G43 There is no objection to the schedule of pruning works that has submitted in the application. The two main stems of the tree are in such close proximity, that a significant tight union has been created. The pruning works will reduce the overall stress/weight that is placed upon this union, therefore reducing the possibility of full or partial failure in the future. Refused Works: ? T42 While the Tree Service appreciates the concerns raised. The tree is in good condition with no obvious signs of any significant defects. The unions at the crown break did not raise any concern. The work applied for would constitute the removal of a significant amount of canopy. This would have a detrimental impact upon the health of the tree due to the the amount of pruning wounds created and the subsequent reduction in the photosynthetic capacity of the tree. The amenity value of such a prominent tree would also be adversely affected by the proposed work. ? T44 The tree is in good condition with no obvious signs of any significant defects. The mentioned cavity in the application did not raise any concern. The work applied for would constitute the removal of a significant amount of canopy. This would have a detrimental impact upon the health of the tree due to the size and amount of pruning wounds created and the subsequent reduction in the photosynthetic capacity of the tree. The amenity value of such a prominent tree would also be adversely affected by the proposed work. ? T45 The tree is in good condition with no obvious signs of any significant defects. Again, the work applied for would constitute the removal of a significant amount of canopy. This would have a detrimental impact upon the health of the tree due to the size and amount of pruning wounds created and the subsequent reduction in the photosynthetic capacity of the tree. The amenity value of such a prominent tree would also be adversely affected by the proposed work. It is however acknowledged that some works are required so the following lesser works are given consent: Consented Lesser Works: ? T42 Selectively prune branches (crown lift) to provide a 5.4m clearance above ground level for the adjacent highway and balance the crown to clear the memorial headstones within the grounds of Christ Church. ? T44 Selectively prune branches (crown lift) to provide a 5.4m clearance above ground level, in doing so clearing the adjacent highway and lamp column. Crown lift the tree to provide a 3m clearance above ground level over the grounds of Christ Church. ? T45 Selectively prune branches (crown lift) to provide a 5.4m clearance above ground level, in doing so clearing the adjacent highway and BT cables. Also Crown lift the tree to provide a 3m clearance above ground level over the grounds of Christ Church. Remove one large limb as indicated in the image provided. Conditions: The removed tree must be replaced with a newly planted tree. The replacement tree must be planted within 12 months of this letter; and of a size not less than 10-12cm girth when planted. It is recommended that planting takes place between the months of October and February but being careful to avoid periods of waterlogging or hard frost. If the new tree species is different from that removed then Rotherham’s Planning department must be consulted before planting is completed. All tree works shall be carried out in accordance with British Standard 3998: 2010 and shall not exceed the description of applied works. Informatives: Please be aware that the removal of deadwood and detached branches is exempt from normal application procedures. It is advised that the attachment of habitat/bird boxes is carried out in a non-invasive way. Please note the authorised works should be completed within 2 years of the decision notice otherwise a new application for consent to carry out any non-exempt tree work will be require
