Both trees
The proposed works do not provide a suitably detailed level of information required to
determine what action will be carried out. British Standard 3998:2010 Tree Work –
Recommendations, section 7.7.2 states that a work specification should:
'be accurate and clear, so that the desired result is achieved. To avoid ambiguity, the
specified end result can be stated either as the tree-height and branch-spread which are to
remain, or the average equivalent in branch length (in metres).' The proposed works do not
provide such detail.
Birch
The proposed works will likely go beyond the recommendations set out in British Standard
3998:2010 Tree Work – Recommendations, section 7.7.2. Healthy and structurally sound
trees are capable of tolerating crown reductions of 30% of leaf volume, which is detailed as
approximately 12% of branch length (allowing for variation in species). The proposed works
go well beyond this maximum level and as no information has been provided to show
special/exceptional reasons (subsidence damage, structural damage to the tree, etc.) for
such a level of reduction the works are refused.
Maple
Beyond the lack of detail in the work specification, the branches in the area described
already provide more than adequate clearance of the fence line and the neighbouring
property.
It is however accepted that some lesser works are appropriate to the Birch tree due to its
close proximity to the neighbouring house; therefor eth following lesser works are granted
consent:
Selectively prune secondary and tertiary branches to provide a maximum radial clearance of
2 metres from adjacent buildings.
Conditions:
All tree works shall be carried out in accordance with British Standard 3998: 2010 and shall
not exceed the attached schedule of tree work(s).
Informatives:
Please note the authorised works should be completed within 2 years of the decision notice
otherwise a new application for consent to carry out any non-exempt tree work will be
required.
Please be aware that permission is not required from the local authority to remove dead
branches or ivy from trees. Such works are exempt under the TPO legislation.
