01
The Council considers that the proposed single-storey extension to the lower store by virtue of its location, size and the use of its roof as a raised patio in close proximity to the boundary with No. 27 Upper Wortley Road would result in a loss of privacy due to overlooking, be over dominant, overbearing and create an oppressive boundary. As such, the proposal would be detrimental to the amenities of the occupiers of 27 Upper Wortley Road, contrary to paragraph 127 of the National Planning Policy Framework, Policy SP55 ‘Design Principles’ of the Local Plan and the Interim Planning Guidance - ‘Householder Design Guide’.
Positive and Proactive Statement
The applicant did not enter into any pre application discussions with the Local Planning Authority. Whilst discussions during the determination of the application have identified a possible acceptable alternative to this proposal, the applicant has not amended the scheme. The scheme as originally submitted is not considered to be in accordance with the principles of the National Planning Policy Framework and has resulted in this refusal.
