Conditions / Reason for Refusal: 01 The 3 upper-level container storage units, by virtue of their siting and appearance in a prominent position, results in an incongruous feature which is clearly visible within the street scene and has a significantly detrimental impact on the appearance of the scene and character of the area. As such the development is contrary to Local Plan policies CS28 ‘Sustainable Development’ and SP55 ‘Design Principles’, and the NPPF. POSITIVE AND PROACTIVE STATEMENT The applicant did not enter into any pre application discussions with the Local Planning Authority. Discussions during the determination of the application have identified that it is not possible to support a scheme of this nature nor would any amendments make it acceptable. It was not considered to be in accordance with the principles of the National Planning Policy Framework and resulted in this refusal. Informative(s) 01 Enforcement action has been authorised requiring the removal of the 3 upper-level container storage units with a compliance period of 3 months. Appropriate action should be taken to secure the removal of the 3 upper-level container storage units from the site to avoid formal enforcement action (B) That the Chair and Vice Chair in conjunction with the Director of Planning Service, authorise the service of an Enforcement Notice under Section 172 of the Town and Country Planning Act 1990, on the OWNER / OCCUPIER of, and anyone else having an interest in, the land at TSD Motor Sales Ltd , Old Doncaster Road , Wath-Upon-Dearne S63 7EE, requiring the removal of the 3 upper-level container storage units with a compliance period of 3 months, and Prosecution action should the steps not be taken within the required time period.
