Conditions / Reason for Refusal: That the illuminated sign indicated as sign 1 on the submitted plan (ref: JBA.4504.101) is approved subject to the recommended condition set out below: 01 The consent hereby granted shall relate to sign 1 indicated on drawing ref: JBA.4505.101. Reason To define the permission and for the avoidance of doubt. That the illuminated signs numbered 2 and 3 and the 2no. LED monitors on the submitted plan (ref: JBA.4504.101) are refused for the reasons set out below: 01 The Council considers that Signs 2 and 3 are of a poor quality and with their prominent siting have an adverse impact on visual amenity by virtue size, scale and projection. The signs are prominent features on the building and have a significantly detrimental impact on the character and appearance of the host building and appear unduly prominent in the streetscene that results in visual clutter, which detracts from the visual amenity of the host building, streetscene and immediate surroundings. As such the proposal is contrary to Local Plan Policy SP60 ‘Advertisements’, as well as the National Planning Policy Framework and National Planning Practice Guidance. 02 The Council considers the 2 Illuminated LED display monitors, by virtue of its siting on the front of the premises fronting South Street in a residential location has an adverse impact on visual amenity that harms the character and appearance of the host property, the streetscene and wider surrounding area. Accordingly, the LED monitors are contrary to Local Plan Policy SP60 ‘Advertisements’ and the National Planning Policy Framework. Informative(s) 01 Please note that the Chairman and Vice Chairman in conjunction with the Director of Planning Service, have authorised Prosecution under Section 224 of the Town and Country Planning Act 1990, on the OWNER and / or OCCUPIER, and anyone else with an interest in the land at 33 South Street, Rawmarsh, S62 5RF as the signs (2 and) and the 2 no. LED screens are in contravention of the regulations under S220 and an offence under of S224(3) of the TCPA 1990. Prosecution action will be pursued should no appeal against the refusal of advertisement consent be submitted within the prescribed appeal time period.
