Development has begun before the receipt by the developer from the local planning authority of a written notice giving their prior approval, contrary to A.4(10) of Class A of Part 1 in Schedule 2 of the Town and Country Planning (General Permitted Development) (England) Order 2015, as amended. The proposal cannot therefore be determined under the Prior Approval procedure and planning permission is required.

The proposed single storey rear extension, by virtue of its overall size and scale and its proximity to the shared boundaries with the adjoining properties at no. 23 Topfield Lane and 19 Topfield Lane and their private amenity space, is considered to be overly dominant, overbearing and would result in a loss of light and overshadowing impact. The proposal is therefore contrary to Local Plan Policy SP55, SPD Householder Design Guide and paragraph 135f of the NPPF (2024).
