The Council considers that the applicant has failed to provide sufficient evidence to demonstrate that, on the balance of probability, the use of the land for a car repair business has been in place on a continuous basis for ten years prior to the submission of the current application. As such the Local Planning Authority is not satisfied that the use as described above is lawful.
Informative
Enforcement action has been authorised requiring the cessation of the use of the
land as a car repair business and the removal of all storage and equipment
associated with the car repair use. Use of the premises should cease to avoid formal
enforcement action being taken in this respect.
