Conditions / Reason for Refusal: 01 The development hereby permitted shall be commenced before the expiration of three years from the date of this permission. Reason In order to comply with the requirements of the Town and Country Planning Act 1990. 02 The permission hereby granted shall relate to the area shown outlined in red on the approved location plan and the development shall only take place in accordance with the submitted details and specifications and as shown on the approved plans Reason To define the permission and for the avoidance of doubt. 03 The use hereby permitted shall only be open for business purposes over a maximum of 5 days a week, between the hours of 08:00 and 18:00 on Mondays to Saturdays, and 10:00 and 16:00 on Sundays. Reason To safeguard the amenities of the occupiers of nearby properties in accordance with RMBC Policy SP52 and parts 12 & 15 of the NPPF. 04 All grooming shall be by appointment only. There shall be a maximum of 1no. dog on site at any one time. The maximum number of appointments shall be limited to 5 no. per day between Mondays and Saturdays, and 4 no. per day on Sundays. There shall be a minimum period of 15 minutes between the end and start times of each consecutive appointment. Reason To safeguard the amenities of the occupiers of nearby properties in accordance with RMBC Policy SP52 and parts 12 & 15 of the NPPF. 05 Except for access and egress, all external windows and doors to the building shall be kept closed during operations. Reason To safeguard the amenities of the occupiers of nearby properties in accordance with RMBC Policy SP52 and parts 12 & 15 of the NPPF. 06 Prior to the commencement of the use hereby approved the building shall be insulated by the installation of timber studwork around the perimeter of the converted room creating cavity walls. The studwork will be insulated twice with PIR insulation and the roof void will be insulated with 300mm thick loft insulation. All insulation shall be maintained throughout the duration of the consent. Reason To safeguard the amenities of the occupiers of nearby properties in accordance with RMBC Policy SP52 and parts 12 & 15 of the NPPF. 07 No noise generating fixed plant including mechanical ventilation or air conditioning shall be installed in any part of the development until full and precise details have been submitted to and approved in writing by the Local Planning Authority. The details shall include a BS4142:2014+A1:2019 noise assessment and 1/3 octave frequency analysis with appropriate corrections for acoustic features and shall detail any mitigation measures, physical or operational to achieve a maximum cumulative plant Noise Rating Level of no more than 0dB(A) above the prevailing background levels, outside the boundary of the nearest noise sensitive property. Positive and Proactive Statement During the determination of the application, the Local Planning Authority worked with the applicant to consider what amendments were necessary to make the scheme acceptable. The applicant agreed to amend the scheme so that it was in accordance with the principles of the National Planning Policy Framework.
