Conditions / Reason for Refusal: 01 The Council considers that the proposals do not represent comprehensive development and would largely stymie future comprehensive development of neighbouring garden land, contrary to Policy SP12 ‘Development on Residential Gardens’ and guidance contained in the NPPF. 02 The proposed development would directly overlook neighbouring residents and due to the proximity to the boundary with neighbouring properties to the north and south, the proposed dwellings would appear overbearing and oppressive against the boundary. As such, the proposals are contrary to Core Strategy Policy CS28 – Sustainable Design and Policy SP12 ‘Development on Residential Gardens’ and advice contained in the NPPF. 03 The applicant has failed to provide information that demonstrates the potential impact on roosting bats and has not included all the habitat areas on the site within their submitted reports. As such, there is insufficient information for the proposal to be properly assessed contrary to the requirements of Local Plan Policy SP33 ‘Conserving and Enhancing the Natural Environment’ and requirements set out in the Environment Act 2021. 04 The Council considers that the width of the access drive of 3.1 metres is too narrow to serve the development of this kind and could cause problems with vehicular conflict. The applicant has also failed to clarify how No. 3 Nursery Road would access and egress from their property. Therefore, the inadequate road layout and lack of information would be detrimental to road safety contrary to paragraph 115 of the NPPF. POSITIVE AND PROACTIVE STATEMENT The applicant did not enter into any pre application discussions with the Local Planning Authority. It is not possible to support a scheme of this nature nor would any amendments make it acceptable. It was not considered to be in accordance with the principles of the National Planning Policy Framework and resulted in this refusal.
